Jakarta – Through Permenhub 118 Year 2018, the government prohibits applicators from giving cheap promo rates for online taxis. This new rule is considered to protect the weak.

“We welcome and appreciate the existence of Permenhub 118/2018, which was issued on December 18 because it regulates enough protection for drivers and passengers. This is clearly a regulation that protects the weak,” said KSPSI Deputy Chairperson for Worker Welfare Improvement Moh Jumhur Hidayat on Friday (12/28/2018).

Jumhur said that this regulation should not only be appreciated in terms of transportation but at the same time needs to be appreciated in terms of employment. In short, matters related to labor that should be the concern of the Ministry of Manpower have been able to be overcome by the new Permenhub 118/2018.

“If there is a proverb once the paddle of two islands is exceeded, then here the signature of the two regulatory perspectives has been presented, which is related to land transportation and labor protection,” he explained.

In this Permenhub, continued Jumhur, online taxi operator companies can no longer freeze the driver’s account arbitrarily. There must be a warning or notification before the driver’s account is turned off.

In addition, drivers also have refutation rights and clarification if they feel there is injustice in the process.

“Meanwhile, for passengers, the protection concerns security and safety, a more certain rate, a history of vehicle maintenance according to the standard applies and the ease of complaints,” he said.

According to Jumhur, the struggle to achieve justice in a situation of regulatory vacancies is indeed not easy. This is mainly related to the development of digital technology which can revolutionize various business models in many fields.

“The existence of online taxis forces policy makers to think out of the box because old regulations and conventional regulations cannot manage such a business model,” Jumhur said.

In the transportation perspective, for example, there is no known black-scale public transportation. Usually also must meet safety and security standards with the presence of KIR routinely as well as special signs that can recognize that the vehicle is a public transport such as colors, stickers and so on.

“Likewise in the employment perspective, the online taxi business model is different from the conventional employment relationship where there are wage companies and wage-receiving workers. In fact, this working relationship on online taxis is called a partnership,” he explained.

They are forced to follow all the rules of the online taxi company operator unilaterally and if they do not follow easily the online network is frozen or turned off so that the partner cannot operate to make a living.

“Of course this is very detrimental to the driver’s partners, because they do not have a bargaining position at all before the company,” he concluded.
