In its verdict, the Supreme Court views the regulation as contrary to higher legislation, that is, contrary to the principle of fair economic democracy, and the agreement between the service user and the special lease business.

The Supreme Court regretted the drafting of the regulation because it was not based on the principle of deliberation and consensus of all relevant stakeholders.
